今回は、「レ社に就職できなかった中国人４人（正犯）は、大学卒業後も、
学生時代にアルバイトで働いていた飲食店で、引き続き働いていて、・・・・」

レ社に就職できなかった中国人４人（正犯）は、大学卒業後も、

２０１０年に、入管法７０条の４（在留資格外活動による不法就労）で、逮捕された。
しかし、正犯を雇用した飲食店の事業者は、いずれの事業者も、
入管法で定める７３の２条（不法就労助長罪）で逮捕されず、何の処分も受けていない。
取調べ調書をみると、雇用した事業者は、いずれも、中国人4人が、
働く資格があることを、確認することを、怠っていたと供述している。
私および元部下である採用を担当した中国人、KinGungakuは、
７３の２条に規定する行為をしていないにも関わらず、
採用予定の正犯に、「内容虚偽の雇用雇用書」を提供した行為（入管法22条のー４の４）を理由に、
在留資格が得られたので、日本に在住できた。
日本に在住できたので、正犯は不法就労をすることができた。
よって、「内容虚偽の雇用契約者を提供した行為と不法就労との因果関係は明白である。
としての刑法の幇助罪が適用され、２０１０年６月に逮捕され、７月に起訴された。
