職務権限について、警察官について言えば、
刑事訴訟法第百八十九条警察官は、それぞれ、
他の法律又は国家公安委員会若しくは都道府県公安委員会の定めるところにより、
司法警察職員として職務を行う。
司法警察職員は、犯罪があると思料するときは、犯人及び証拠を捜査するものとします。
と規定されています。
よって、犯罪が思料されない、つまり、なんら法に違反していないのに、
捜査、逮捕、監禁することは、不法な行為であり、特別公務員職権乱用罪にあたります。
不法な内容嘘偽の逮捕状等を提示するなどして意思決定の自由を圧迫し職務上の権限を行使しています。
特別公務員職権濫用罪は故意を必要としていませんので、
この明らかな不法な行為は、職権乱用であるので、犯罪は成立します。

起訴状の訴因は、行政処分である、入管法22条の４－４の幇助行為を指摘しています。
ですから、警察官は「一般論で犯罪を認めろと言って自白を強要します」。
日本だって憲法31条により「罪刑法定主義」の国家です。
この適用法誤りが理解できないのが国会議員です。
もはや日本は法治国家ではありません。
