レフコ社の社長である私は、採用予定の中国人４人に対し、２００９年１月頃までに採用予定を出した。
しかし２００８年秋のリーマンショックで、受注予定が激減したため、
２００９年３月に、採用予定（内定）を取り消した。
中国人は、既に在留資格の更新を終えていた。
以前入国管理局から以下のように言われていた。
在留資格は、日本国が雇用予定の会社に対して交付するものではない。
在留資格は外国人個人に交付するものだ。
採用を取消をしても発行した在留資格の取消はできない。
在留資格を得た外国人が在留資格の範囲で、どこの会社で働くかは自由である。
在留資格以外で働けば、外国人は「不法就労罪」。
事業者は「不法就労助長罪」で処罰される。
中国人4人は、在留資格の職種ではなく、学生時代に働いていた飲食店で働いたので逮捕された。
しかし、私が中国人4人に内容虚偽の雇用契約書を提供したから在留資格が容易に取得できた。
それが不法就労の幇助罪（刑法）だというのです。
内容虚偽の雇用契約書の提供を受けて、在留資格を得た場合は入管法の22条の４ー４で、
在留資格取消の行政処分を受ける規定です。これが日本国の司法の実体です。
