Dear sirs. Those who illegally employ "foreigners who are not eligible to work" are criminalized
under the crime "promoting illegal labor".
In Japan, policies that do not accept simple
and unskilled labor have been taken continuously by the Immigration Control Law.
However, since the number of illegal workers has increased sharply since around 1985,
as a measure to cope with it,
a crime of promoting illegal employment (Immigration Act 73-2) was established as a result
of the revision of the law in 1989.
The legal basis is Article 73-2 of the Immigration Control Act (a crime of illegal employment promotion).
Article 73-2 A person who falls under any of the following items shall be punished
by imprisonment with work for not more than 3 years or a fine of not more than 3 million yen, or both.
1, Person who caused foreigners to engage in illegal employment activities
with respect to business activities.
2. Person who put this under self-control to make foreigners work illegal employment.
3, As a business, an act of causing a foreign national to work illegally,
or a person who "mediated" the act of the previous issue.
2: A person who has conducted an act falling under any of the items
of the preceding paragraph shall not "escape" the "punishment"
under the provision of the same paragraph with "not knowing"
that it falls under any of the following items .
Provided, however, that this shall not apply when there is no negligence.
1. That the activity of said foreigner is an activity to manage a business accompanied
by income not belonging to an activity corresponding to the status of residence of said alien
or activity to receive remuneration.
2. The foreign national has not received permission under Article 19,
paragraph 2 when conducting the activities of said alien.
3. The persons prescribed in paragraph (1) of paragraph 1, items 1 to 3-2, 5, 7 to 7 - 3,
or 8 - 2 to 8 - 4 .
(Both punishment provisions)
A representative of a juridical person, a representative of a juridical person,
a "representative", "employee" or any other "worker" of a juridical person
or a person shall be deemed to be in compliance with Article 73-2 or Article 74 to Article 74-6
In the case of committing a crime of offenses, Article 74,
paragraph 2, 2 (excluding paragraph 1, item 3 and item 4) or its attempted offense or Article 74 8,
the actor shall be punished,
The juridical person or person shall also be punished by the fine prescribed in each Article.
