１．オーバーステイなどで、すでに、国外退去の行政処分となる外国人が、
入管法違反の状態で、不法就労をした場合は、「不法就労罪」で処分しなくとも、

オーバーステイなどの理由で国外退去させています。

２．正規の在留資格で、資格外活動の不法就労をした場合は、
外国人だけを、入管法違反（資格外活動による不法就労）にして、
少額の罰金刑にして、刑事処分をして、刑事処分されたことを理由に国外退去させています。

しかし、この場合も、外国人に対する恣意的な処分ですから、国際法違犯です。
