日本はテロ犯罪を防ぐためとして、「国際組織犯罪防止条約」を批准し、必要な国内法として、「組織犯罪処罰法」の改正案「テロ等準備罪」（共謀罪）を、新設しようとしています。
刑法では、危険性がある行為を処罰するのが原則で、未遂や予備の処罰でさえ例外とされています。
ところが、予備よりもはるかに以前の段階の行為を共謀罪として処罰しようとしています。
戦前の日本は軍国主義ですから、「治安維持法」により未遂や予備行為を処罰してきましたので多くの国民が危惧しています。（治安維持法は戦後廃止されました。）
「日本弁護士連合会」、「朝日新聞」や「東京新聞」など全面否定の論陣です。私も反対です。
日本では、宗教団体の「オウム真理教」が「サリン」を地下鉄に散布したり、警察長官を狙撃するなどのテロ行為を行いましたが、その前警察長官でさえ、「テロ等準備罪」を新設しても、テロは防げないと断言します。
国際組織犯罪防止条約は、国連加盟国の96％、187か国が締結しており、未締結国は日本を含めて11か国のみであると言いますが、締結国でテロが発生しているのはなぜですか。一緒に考えていただけませんか？日本は、軍国主義の国にしたほうがいいですか？
私は、２０１０年「入管法違反幇助事件」日本政府から受けた、不法な扱いに対して、国連の人権高等弁務官事務所に、「個人通報制度」で告訴したいのですが、「個人通報制度」の批准をしていないのでできません。「個人通報制度」の批准をするほうが先だと思います。
