I spoke with Chinese and Myanmar people who violated the Immigration Control Act. They are “illegal immigrants whose period of residence has been exceeded”. But I have seen many victims of immigration law. Japan's migrant measures punish “regular immigrants” illegally for the purpose of “forcibly leaving the country”. This issue will not be resolved unless each country legislates a bill seeking “governance under Japanese human rights and law”.


Part 1. There are too many victims of this incident.
I was arrested and re-arrested.
So I was arrested and confined to a “detention center” for over 40 days.
From the "Police Detention Center", you will be placed on the "Escort bus" early in the morning.
"Destination" is "Tokyo District Public Prosecutor's Office" or "Tokyo District Court".
Until it arrives at the destination, the “Escort bus” goes around the police stations
in Tokyo in order to “pick up” the “suspect” who is “contained” in each police station.
The police station “picks up” foreigners from various countries to “Escort bus”.
If you visit more than 10 police stations, the “Escort bus” will be full of “suspects”.
In the morning, we will arrive at the “Tokyo District Prosecution”
and “Tokyo District Court” at around 9am.
At the Tokyo District Court, I spend my day sitting in a chair handcuffed in a large waiting area.
The interview with the judge is about 10 minutes.
The rest is spent in a large waiting area.
More than 100 "suspects" are waiting.
At the Tokyo District Public Prosecutor's Office,
a group of about 10 people will wait in the “iron lattice room”.
I think there are about 20 “iron lattice rooms”.
The suspect is "handcuffed" and spends a day.

And in the evening, get on the “Escort bus”.
Contrary to the morning, the “Escort bus” goes around the police station and drops the “suspect”.
The time to return to the police station is from 17:00 to 18:00.

The police “detention center” has several people in one room.
In the room, "suspects" will call each other by "number".
The suspect can talk freely.
During the day, there is a break for about 10 minutes.
So I've seen a lot of foreigners and Japanese people.
Many Japanese are "suspects" of "drug crime".
Many foreigners are “suspects” of “violation of immigration law”.
I saw an American but did not talk.
The Americans also seemed to be “violating the Immigration Act”.

Part 2. I “sue” two things.

I'm not only Chinese and Philippine,

1. Foreigners performed “illegal labor” other than “qualification of residence”.
But foreigners are innocent.
Only foreigners were punished for the immigration law article 70 “Illegal Labor Crimes”.
On the other hand, the Immigration Control Act punishes employers
who are “causal” of illegal labor under the Immigration Act Article 73-2
(a crime that promotes illegal employment).
However, the Japanese judiciary “punished” foreigners only, but not “employers”.
This is clearly contrary to Article 14 “Principles of Equality under the Law”
of the Japanese Constitution.
It violates international law that prohibits "consciously" "punishing" only foreigners.
If an employer who hires a foreigner illegally is "innocent",
an illegally employed foreigner is also "innocent". .

2. The prosecution “applied” the crimes supporting other crimes in Articles 60
and 62 of the Penal Code against Article 70 of the Immigration Act on the grounds
of “supporting the Immigration Law Article 22-4-4” Is an error in the law.
"Article 22-4-4 of Immigration Law" is the disposal
of those who have obtained the status of residence through fake application.

Previously, the Immigration Control Act was not subject to penalties
for those who obtained status of residence through false applications (Article 70, Article 74-6).
The Amended Immigration Act was enacted at the 192nd Special Diet session
for those who obtained status of residence through falsification applications,
office workers who helped them, lawyers, administrative scriveners, and school staff.
“Effective from January 1, 2017”.

"I, KinGungaku, Philippine diplomat and Philippine embassy employee" is 100% "innocent".

“Reference”: Foreigners acted in accordance with Article 22-4-4
(Acquisition of status of residence by submitting false documents).
However, there is no “criminal punishment” for this.
Disposal is “cancellation of status of residence” and “forced relocation”
by the Minister of Justice.
Therefore, the “crime to support other crimes”
in Articles 60 and 62 of the Penal Code is not applicable.
The “reason for crime” in Article 22-4-4 of the Immigration Act pointed out
by the “Indictment” is not causal to Article 70 of the Immigration Act.

The prosecutor is "crush something in one's hand".
However, “crush something in one's hand” by the state power is “stop”
of “aging, statistics of limitations”.
